Nestor E. Menendez focuses his practice on complex commercial litigation and business disputes, as well as white-collar criminal matters, encompassing a number of substantive areas, including the Foreign Corrupt Practices Act and other anticorruption regimes, anti-money laundering, and internal investigations. Nestor represents clients at both the state and federal levels.
Prior to joining DiFalco & Fernandez, Nestor worked at a boutique law firm with a top-tier team of former Assistant U.S. Attorneys and former U.S. Attorney for the Southern District of Florida, focusing mainly on white collar criminal matters, internal investigations, and commercial disputes. Prior to that, Nestor worked at one of the nation’s leading plaintiff firms, focusing on class action and multi district litigation, personal injury/wrongful death, complex commercial business litigation and aviation tort law.
Nestor earned his J.D. at the University of Miami School of Law, where he was a member of the Charles C. Papy Moot Court Board and competed in the Herbert Wechsler National Criminal Moot Court Competition. Additionally, Nestor participated in the University of Miami School of Law, STREET Law program, where he taught introduction to law to high school students.
Nestor is fluent in Spanish, conversational in Portuguese, and introductory level Italian.

- Part of team that represented the Court-Appointed Receiver in one of the nation’s largest SEC actions against a Merchant Cash Advance company. (SEC v. Par Funding et al.)
- Part of team that secured a successful confidential settlement in an Anti-Terrorism Act MDL. (In re Chiquita).
- Member of team that initiated the products liability MDL against the manufacturers of Zantac. (In re Zantac).
- Successfully defended a commercial dispute involving the disassociation of several doctors from a South Florida Pulmonary practice group. (SFPCC).
- Part of trial team that secured not-guilty verdict in federal court for an indigent client accused of minor drug charges but charged as a career criminal. (U.S. v. Simmons).
